District Court Rules against EIA

EIA Plans to Appeal

December 30, 2009 -- Roanoke, Virginia -- Judge Glen E. Conrad of the U.S. District Court for the Western District of Virginia ruled against the challenge by Equity in Athletics, Inc. (EIA) to the decision by James Madison University ("JMU") to demote ten intercollegiate athletic teams to club status.

"Based on the views he expressed when EIA sought a preliminary injunction, we did not expect a favorable result from Judge Conrad," said Lawrence J. Joseph, one of EIA's counsel. "This case ultimately will be decided on appeal," he added, noting that that whichever party won, the other would appeal to the U.S. Court of Appeals for the Fourth Circuit in Richmond.

EIA’s counsel are Larry Joseph (Washington, D.C.), Douglas G. Schneebeck (Albuquerque, New Mexico) and Thomas H. Miller (Roanoke, Virginia). Schneebeck is a graduate of James Madison University, and was the captain of JMU’s 1982 track and field squad. Men’s track is among the sports set for elimination by JMU.
